Heard Ms.Dhana Lakshmi for petitioners and the Assistant Government Pleader for Home.
The petitioners complain against the 3rd respondent in not providing police protection as requested and as ordered in Crl. MP No.1105/ 2013 in DVC No.9/ 2013, as illegal arbitrary and refusing to exercise the jurisdiction.
After perusing the counter affidavit, I am satisfied that the inaction complained against 3rd respondent need not be considered, for the reply of 3rd respondent reads as follows: "It is respectfully submitted that while the matters stood thus, on 2.3.2013 one Smt.Kathari Silatha-5th respondent herein had approached this respondent police station and lodged a complaint against her in-laws who are the petitioners herein and also requested to provide police protection from her in laws and relatives. An acknowledgement was given to the said complaint on 2.3.2013. Upon receipt of the said complaint, this respondent visited the house of the petitioner herein and caused enquires in the vicinity. After that, both parties were summoned to the police station and both parties voluntarily executed bound over letter to this respondent for not to any harassment with each other and to live peacefully without any disputes.
It is respectfully submitted that action was taken on the complaint of the petitioner herein by summoning the parties and provided police protection as requested. Both parties have given bound over letter to this respondent stating that they are not harassing with each other and to live peacefully without any disputes. A copy of the letter given by both parties ie., petitioners on one hand and the unofficial respondents herein on the other
hand is filed along with this letter for the kind perusal of this Hon'ble Court. It is humbly submitted that this respondent is ready and willing to provide police protection as and when the petitioner is required. Hence the writ petition deserves no consideration." The stand of 3rd respondent is placed on record and the writ petition is disposed of. No order as to costs.
