THE HON'BLE SRI JUSTICE S. RAVI KUMAR CRP No.1701 of 2012 ORDER:

This revision is preferred against order dated 24-02-2012 in I.A.No.2/2012 in O.S.No.481/2004 on the file of Principal Junior Civil Judge, Palakol whereunder the Court below refused to appoint Advocate Commissioner to note down the damage caused to BD Wall.

2. This Court permitted the petitioner to take personal notice on respondents 1 to 3 and file proof of service and this order was passed on 10-04-2012, no proof of service was filed. On 22-2-2016, there was no representation for the revision petitioner, therefore, directed the matter to be posted under the caption of dismissal on 02-3-2016. On 02-3-2016, at request of Advocate for petitioner, the dismissal caption was deleted and again permission

was accorded to the counsel for the petitioner to take fresh personal notice to respondents thorough registered post with acknowledgement due and file proof of service.

3. In spite of that, no proof of service is filed and today when the matter is taken up, neither Advocate for petitioner is present nor any representation is made, therefore, Civil Revision Petition is dismissed for non-prosecution. No costs.
