HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.11649 OF 2006 AND WRIT PETITION No.23438 OF 2006 COMMON ORDER:

These two writ petitions are being disposed of by this common order as they relate to acquisition of land situated in Rampalem Village, Gopalapuram Mandal, West Godavari District.

W.P. No.11649 of 2006 was filed challenging the declaration issued under Section 6 of the Land Acquisition Act, dated 21.05.2006 in respect of the land to an extent of Ac.1-02 cents in RS. No.350 of Rampalem Village, Gopalapuram Mandal, West Godavari District. Whereas W.P.No.23438 of 2006 was filed challenging the declaration issued under Section 6 of the Land Acquisition Act, dated 27.7.2006 in respect of the petitioner's land situated in Sy.No.321/2 of Rampalem Village, Gopalapuram Mandal, West Godavari District.

The 3rd respondent - Mandal Revenue Officer, Gopalapuram Mandal, W.G. District - filed counter-affidavit stating that another proposed land under Indiramma Housing Programme for an extent of Ac.1-00 cents in RS. No.358/2 of the same village was approved and the possession was taken on 18.01.2007. It was also stated that pattas were distributed to 30 houseless families in Rampalem village. In view of the same, it is stated that the lands covered under the present writ petitions are not needed for house sites purpose as another extent of land was already acquired and house site pattas were also issued to the beneficiaries.

Recording the said statement, both the Writ Petitions are closed as no further orders are necessary. No order as to costs.

As a sequel, miscellaneous petitions if any pending in both the writ petitions shall stand closed.
