THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M.GANGA RAO WRI T APPEAL No.172 OF 2018 JUDGMENT: (per Hon'ble Sri Justice Sanjay Kumar) We find from the order dated 19.02.2018 passed in this appeal by the Division Bench which heard this matter earlier that Sri S.Ravindranath, learned counsel for the appellant, submitted that in view of the proceedings dated 17.02.2018, the appellant wanted to withdraw the appeal with liberty to file written arguments before the Labour Court. Though the Division Bench granted liberty to the appellant to file written arguments before the Labour Court within a time frame, no mention was made as to the dismissal of the writ appeal as withdrawn. Sri Salloori Ramesh, learned counsel for the third respondent, would state that Sri S.Ravindranath, learned counsel, informed him that he still stands by the submission made on 19.02.2018 to the effect that his client wanted to withdraw the appeal.

The writ appeal is accordingly dismissed as withdrawn leaving it open to the appellant to pursue the matter before the Labour Court concerned.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
