ORDER
This writ petition is filed seeking to declare the action of the 2nd respondent in not taking action on the representations of the petitioner association dated 24.01.2019 and 18.02.2019 complaining about the illegal encroachment of the 3rd respondent over the public road in Sai Mahendra Colony, as illegal and arbitrary. 2.
The grievance of the petitioner is that the 3rd respondent is making constructions occupying 30 feet public road. 3.
On 27.02.2019, learned Standing Counsel for the 2nd respondent was directed to get instructions with regard to the allegations of the petitioner as to whether the 3rd respondent has obtained permission for making construction of the compound wall or not. Today, when the matter came up for admission, learned Standing Counsel would submit that the 2nd respondent has already initiated action by issuing notice to the 3rd respondent. However, the 2nd respondent is silent whether the permission was granted to the 3rd respondent or not.

In those circumstances, the Writ Petition is disposed of, with a direction to the 2nd respondent not to give permission to the 3rd respondent for construction without considering the representations
CKR, J W.P.No.4084 of 2019 of the petitioner with respect to the subject property. No order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
