HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.34724 of 2012 ORDER:

1. The petitioner is a producer of the feature film called "A Woman in Brahminism". The Censor Board of Film Certification has issued a certificate on 05.10.2012 to exhibit the film restricting it to adults only. Accordingly, he states that he got a right to exhibit the film. While so, when some persons and social organizations raised objections against the film, the Government issued G.O.Rt.No.2008, Home (General.A.1) Department, dated 03.11.2012 constituting a committee to examine the objections in regard to the said feature film. The same was challenged in the present writ petition.

This Court by order dated 09.11.2012 granted interim stay of operation of G.O.Rt.No.2008 dated 03.11.2012. The said interim order has been in operation till today.

3. Respondents 4 to 6 filed an application seeking to vacate the said interim order. But, in view of the disposal of the writ petition in the manner indicated below, this Court is not inclined to entertain the said petition.

4. No counter-affidavit is filed by the respondents 1 to 3 till today. 5.

In view of the lapse of time and also in view of changed circumstances, this Court is inclined to set aside the G.O.Rt.No.2008, Home (General.A.1) Department, dated 03.11.2012 and gives liberty to the Government to take action in accordance with law after calling the petitioner and the objectors, if any, before taking action.

6. The Writ Petition is accordingly allowed. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed. ______________________________ A.RAMALINGESWARA RAO, J
