HCJ & AAR, J Dt: 26-02-2020 Judgment: (per Hon'ble The Chief Justice Sri Raghvendra Singh Chauhan) Aggrieved by the order dated 23-01-2020, passed by the learned Single Judge, in IA. No. 1 of 2020 in W.P. No. 1293 of 2020, whereby while staying the further proceedings pursuant to the attachment warrant dated 06-08-2019, the learned Single Judge has directed the petitioner to deposit 50% of the amount as quantified by the respondents within a period of six weeks from 23-01-2020.
The learned counsel for the petitioner submits that the petitioner- society is unaware of the total amount that it is liable to be paid towards the contribution, interest, damages, and further interest up to 06-08-2019, on the contribution payable under the Employees State Insurance Act, 1948. Therefore, they are not in a position to deposit 50% as directed by the learned Single Judge. The position being taken by the learned counsel is rather curious. For, in the order dated 06-08-2019, the amount payable is already quantified as Rs.11,14,470/-. Therefore, the position being taken by the learned counsel is highly misplaced. For the reasons stated above, this Court does not find any merit in the present appeal. It is, hereby, dismissed. The petitioner
HCJ & AAR, J Dt: 26-02-2020 is directed to deposit 50% of the aforementioned amount by 15-03-2020.
As a sequel, miscellaneous petitions, pending if any, stand dismissed as infructuous.
