CVNR, J & GSP, J CC.No.495 of 2018 Dt: 09.03.2018 Order: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This Contempt Case is filed alleging willful disobedience of Order, dated 05-11-2017, in FCA.No.112 of 2017, by the respondent.

At the hearing, when a query was put to the learned Counsel for the petitioner, as to whether notice has been sent to the respondent before filing this Contempt Case, he informed that the respondent has left the premises in which she was residing i.e., Flat No.104, Dharani Residency, Plot Nos.51 & 52, Green Hamlet, Kondapur, Hyderabad. However, we find from the cause title that the same address has been given as the residence of the respondent.

In our opinion, when, on the petitioner's own showing, the respondent has left the said premises, he cannot file the Contempt Case with the same address in which the respondent has not been presently residing. Hence, this Contempt Case is, dismissed, however, with liberty to the petitioner to file a fresh Contempt Case with correct and proper address, after issuing notice to the respondent.
