THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.4129 OF 2019 ORDER:
The grievance of the petitioners is that the respondent authorities are trying to interfere with their possession over the subject properties for the purpose of laying road, without paying any compensation. Learned counsel for the petitioners submits that this Court in identical set of facts and circumstances in W.P.No.1875 of 2019, dated 01-02-2019, disposed of the Writ Petition, directing the respondent authorities not to interfere with the peaceful possession and enjoyment of the petitioners over the properties in dispute, without following due process of law. Learned Assistant Government Pleaders for Panchayat Raj and Revenue, do not dispute the above submission of the learned counsel for the petitioners.
Having regard to the above, the present Writ Petition is disposed of directing the respondent authorities not to interfere with the peaceful possession and enjoyment of the petitioners over the properties in question, without following the procedure prescribed under Section 146 of the Greater Hyderabad Municipal Corporation Act, 1955, and without complying with Section 38 of the Right to Fair compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013. There shall be no order as to costs.
