THE HON'BLE SRI JUSTICE B. VIJAYSEN REDDY WRIT PETITION No.4586 of 2021 ORDER:

This writ petition is filed seeking to declare the action of the respondent No.4 in interfering into the civil disputes of the petitioner in respect of land in Sy.Nos.782 and 783 to an extent of Ac.1-27 guntas situated at Aroor Revenue village Sivar, Valigonda mandal, YadadriBhongir district as arbitrary and illegal. 2.

The learned Assistant Government Pleader for Home, having received written instructions dated 4.3.2021 from the Sub-Inspector of Police, Valigonda Police Station, Rachakonda Commissionerate, submitted that respondent No.6 lodged complaint against petitioner and the same was registered as Crime No.164 of 2020 under Sections 341, 427 of IPC and investigation was completed and charge sheet was filed vide C.C.No.711 of 2020. Again another complaint was lodged by respondent No.6 against petitioner and the same was registered as Crime No.196 of 2020 under Sections 341, 427, 506 read with 34 of IPC against petitioner and others. Investigation was completed and charge sheet was also filed in the said crime vide C.C.No.717 of 2020. It is stated by the learned Assistant Government Pleader that except conducting investigation in the above two criminal cases, Police have not interfered with the personal life and liberty

of the petitioner and the Police never threatened the petitioner to settle the civil disputes. It is further stated that in the above two criminal cases, notice under Section 41-A of Cr.P.C. was issued to the petitioner and there is no interference by the Police in the civil disputes of the petitioner. Copies of charge sheets in the above crimes along with written instructions are served on the learned counsel for petitioner. 3.

Recording the submissions of the learned Assistant Government Pleader for Home, the writ petition is closed as no further orders are required to be passed. However, the respondent-Police are directed not to interfere with the civil disputes of the petitioner, without following due process of law. The miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
