HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.3239 of 2015 ORDER :

This Criminal Petition is filed by the petitioner/ accused under Section 482 Cr.P.C seeking to quash the FIR No. 462 of 2014 of A.S.Nagar Police Station, Vijayawada registered for the offences punishable under Sections 376, 417, 420, 506, and 509 IPC and Sections 3 and 4 of D.P Act.

2) Pending disposal of the Criminal Petition, the petitioner/ accused and defacto-complainant both present and filed Crl.P.M.P. No.5419 of 2015 seeking permission of this Court to compound the offences against the accused stating that they amicably settled the matter out of court and there is no offence of rape and monetary claim between them also settled by paying an amount of Rs.4 lakhs to de facto complainant by accused including to withdraw the case, hence to purchase peace and in the welfare and future of bothsides including the victim, permission be accorded to compound the case.

3) Perused the material on record and heard.

4) Accordingly, the Criminal Petition is allowed and all the proceedings relating to FIR 462 of 2014 of A.S.Nagar Police Station, Vijayawada are quashed. The bail bonds of the petitioners, if any, shall stand cancelled.

5) Miscellaneous petitions, if any pending, shall stand

closed.
