HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.23755 of 2005 ORDER:
Heard learned counsel for the petitioners as well as the respondents.
This writ petition is filed by the petitioner to declare the action of the respondents in Proc.No.F-12-10/2003-INC, dated 12.09.2003 and F.No.12-10/2000-INC, dated 16.07.2005 and not registering the petitioner as Male Nurse as arbitrary and illegal.
During the course of the arguments, it is pointed out that the impugned letters have been issued by the 2nd respondent pursuant to the resolution passed by the council, dated 21.11.1986, wherein the council has considered the equation of Trades of Army Medical Corps with Civilian Occupation to facilitate registration of Ex-serviceman i.e., Class-I Nursing Assistant for employment assistance through employment exchange and resolved that this category cannot be equated with General Nurse for the purpose of registration and employment.
Unless the said resolution, dated 21.11.1986, is challenged, the petitioner cannot seek any relief more so contrary to the said resolution. Therefore, counsel for the petitioner sought permission to withdraw the writ petition with a liberty to challenge the said resolution.
Permission accorded.
However, the petitioner is given liberty to challenge the resolution of the 2nd respondent dated 21.11.1986 before the appropriate forum as per law.
In the light of the above, the writ petition is closed. No order as to costs.
Miscellaneous petitions, if any, shall also stand dismissed.
