O R D E R

The prayer of the petitioner in this case is as under: 'To issue a writ, order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondent no.2 in registering a complaint dt.15-02-2016 as FIR as arbitrary, illegal, violative of Principles of natural justice and contrary to Art.14,19 (1) (g) 21 of the Constitution of India and consequently direct the respondent no.2 to register the FIR upon the complaint and to pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

The Sub-Inspector of Police, Veldurthi Police Station, Kurnool District, furnished written instructions dated 24.02.2016 stating that no complaint had been received from the petitioner and that as and when she approached the police station along with a complaint in original, the police authorities would take action thereupon as per law. Smt. Thota Suneetha, learned counsel for the petitioner, fairly stated that in the light of this stand of the police authorities, the petitioner may be permitted to file a fresh complaint.

The writ petition is accordingly disposed of permitting the petitioner to make a fresh complaint to the police authorities concerned and in the event, any such complaint is made, the police authorities shall take action thereupon in accordance with the law laid down by the Supreme Court in LALITA KUMARI V/s. GOVERNMENT OF UTTAR PRADESH[1]. Pending miscellaneous shall stand closed. No order as to costs.
