O R D E R

The 3rd respondent - Tahsildar, granted permission dated 10.3.2017 to the 4th respondent for digging bore well. Aggrieved by the same, petitioner filed appeal before the 2nd respondent - District Collector alleging that the permission granted to the proposed bore well is not satisfying the spacing stipulation between two bore wells, which are existing within 100 meters. Along with the appeal, the petitioner also filed interim application seeking stay of the order of the 3rd respondent. Aggrieved by the action of the 2nd respondent - District Collector in neither passing any order on the stay petition, nor disposing of the appeal, the present writ petition has been filed. Heard the counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

Having regard to the above facts and circumstances, as the petitioner has already availed the appellate remedy against the order dated 10.3.2017 passed by the 3rd respondent - Tahsildar, without expressing any opinion on merits, the writ petition is disposed of at the stage of admission, directing the 2nd respondent to dispose of the stay petition/appeal after issuing notice to the petitioner and the 4th respondent and affording them an opportunity of hearing, shall pass appropriate orders in accordance with law, as expeditiously as possible, preferably within a period of three weeks from the date of receipt of a copy of this order.

No order as to costs.
