THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.2466 of 2016 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash proceedings initiated against the petitioner/A-2 in Crime No.59 of 2016 of Shahinyatgunj Hyderabad, registered for the offences punishable under Section 272 and 420 read with Section 34 IPC.

Heard and perused the material available on record. The main grievance of the petitioner is that in the complaint it is nowhere stated the adulterated oil of Gopi Krishna Brand is compared with original brand and it is nowhere stated about sending of the alleged adulterated oil for examination. Even the allegations of the complaint are taken at their face value and in its entirety, the same have to be necessarily investigated into, the truth or otherwise of which can be ascertained by the police during investigation.

Having regard to the facts and circumstances of the case and in view of the nature of the offences alleged, this Court is of the view that it is not a fit case to quash the proceedings. At this stage, the learned counsel for the petitioner submits that the petitioner is apprehending of his arrest in view of pendency of the crime.

Considering the request of the petitioner, the concerned police is directed to complete the investigation without arresting the petitioner/A-2 and file final report before the Court. Accordingly, the Criminal Petition is dismissed. As a sequel thereto, miscellaneous petitions, if any, pending, shall stand closed.
