HON'BLE SRI JUSTICE Dr. B. SIVA SANKARA RAO WRIT PETITION No.3441 of 2018 ORDER:

This writ petition is filed under Article 226 of the Constitution of India, seeking the following relief:

" .....to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the action of the 2nd respondent in not considering the representation made by the petitioner dt 26-12-2017, to permit the petitioner to sell Toddy in hamlet villages of Mulkalapally i.e., Turkonpally and Telugonipally is under one grampanchayath of the TCS Mulkalapally (Village), inspite of repeated visits as being illegal, arbitrary and unjust and consequently direct the respondent authorities to permit the petitioner to sell the toddy in Turkonpally and Telugonipally, and to grant such other relief or reliefs as this Hon'ble Court ....." 2.

Heard the learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise appearing for the respondents and perused the prayer in the writ petition with supporting affidavit and the other material on record including the proceedings of the District Prohibition and Excise Officer, Jogulamba Gadwal District, dated 28.12.2017.

The learned Government Pleader for Prohibition and Excise placed on record, the proceedings dated 28.12.2017, issued by the District Prohibition and Excise Officer, Jogulamba Gadwal District, stating that the so called representation of the petitioner is already rejected and the same is communicated to the petitioner. 4.

Having regard to the above, there is nothing to direct the respondents to dispose of the representation of the petitioner, which was already rejected. However, it is left open to the petitioner to impugn the said rejection order, if otherwise entitled. 5.

Accordingly, this Writ Petition is disposed of. 6.

Consequently, miscellaneous petitions, if any shall stand closed. No order as to costs.
