HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No. 4072 of 2020 ORDER:

This writ petition is filed for the following relief; "to issue an order or direction more particularly one in the nature of Writ of Mandamus declaring that the action of the 4th respondent in entering the name of the 5th respondent in place of the petitioner in the revenue records in respectof the land of the petitioner in Sy.No.23/1 to an extent of 0.36 guntas, Sy.No.22/A1 to an extent of 1.23 guntas, Sy.No.22/A2 to an extent of 1.23 guntas, Sy.No.23/2 to an extent of 0.12 guntas, situated at Dacharam Village, Nereducherla Mandal, Suryapet district and also in dismissing the ROR revision No.F2/864/2018, dated 03.08.2019 by the 2nd respondent without any enquiry and without notice to the petitioner is highly arbitrary, bad and illegal and consequently enter the name of the petitioner in respect of the said lands and pass such other order or orders as deem fit and proper."

Admittedly, petitioner filed civil suit in OS.No.96/2018 and one of the prayers sought in the said suit reads as follows; "iii. To direct the Tahasildar, Neeraducherla Mandal to rectify the wrong entries made in favour of the defendant No.1 in the ROR and cancel the Pattadar Pass Book and book of Title Deed issued by the revenue officials in respectof the plaint schedule property."

In the revision filed by the petitioner before the 2nd respondentJoint Collector, the Joint Collector also dismissed the revision on the same ground that title dispute is pending before the Civil Court between the petitioner and 1st respondent therein, granting liberty to the petitioner to approach the Tahasildar after getting declaration, if any and the entry

in the record of rights shall be amended in accordance with such declaration.

In view of the above, the writ petition is disposed of granting liberty to the petitioner to avail remedy in OS.No.96 of 2018 filed by him before the Court below. No order as to costs. As a sequel thereto, miscellaneous petitions, if any pending, in this writ petition shall stand closed.
