This appeal was adjourned on 04.04.2018 on payment of costs of Rs.1,000/- (Rupees One Thousand only) and, when this appeal is listed today, in the morning a representation was made on behalf of learned counsel for the appellant that costs were paid, but sought adjournment. Since the representation was made by a junior counsel, he was informed to bring the senior counsel who was appearing for the appellant and the matter was passed over to the afternoon. When the matter is called in the afternoon, none appeared on behalf of the appellant. In the circumstances, the Appeal Suit is dismissed for nonprosecution. There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this appeal shall stand closed.
