HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4142 of 2019 ORDER:

The prayer of the petitioners in this case reads as under:- "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the 4th Respondent-Sub-Registrar, Keesara, Medchal-Ranga Reddy District, in refusing to receive and Register the Sale Deeds executed by the Petitioners in favour of Third Party Purchaser in respect of the Land admeasuring 13,800 Square yards (Net Plotted Area) except Roads, Park, Public Utility out of Acs.4.24 Guntas situated in Sy.No.814/A of Ankireddy Palli, Hamlet of Keesara Village, Keesara Revenue Mandal, Medchal Ranga Reddy District, as being illegal, arbitrary and violative of Principles of Natural Justice besides being violative of the Fundamental Rights guaranteed to the Writ Petitioner under Articles 14, 19 and 21 of the Constitution of India and to pass such other order or orders as this Honourable Court may deem fit and proper in the facts and circumstances of the case."

It is not open to the Sub-Registrar, Keesara, MedchalMalkajgiri District, to remain inactive when a document is presented for registration. The Sub-Registrar must either process the document and register the same in the event he finds it to be in order and in compliance with the requirements of the Registration Act, 1908 (for brevity, 'the Act of 1908'), and the Indian Stamp Act, 1899, or record the reasons for refusing registration of such document and communicate the same to the party under Section 76 of the Act of 1908.

The Writ Petition is accordingly disposed of directing the Sub-Registrar, Keesara, Medchal-Malkajgiri District, to act in accordance with the due procedure.
