THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLR SRI JUSTICE M.SATYANARAYANA MURTHY WRIT PETITION No. 8407 OF 2016 ORDER: {Per the Hon'ble Sri Justice Ramesh Ranganathan} Heard Sri S. Ravi, learned Senior Counsel appearing on behalf of the petitioner and Sri T. Vinod Kumar, learned Senior Standing Counsel for Income Tax and, with their consent, the writ petition is disposed of at the stage of admission. Inaction of the respondents in not granting refund of the credit of TDS claimed by the petitioner, despite several representations made by them in this regard, is contended to be illegal, arbitrary and unlawful. A consequential direction is sought to the respondents to refund the TDS credit claimed by the petitioner for the Assessment Year 2009-10.

Sri T. Vinod Kumar, learned Senior Standing Counsel for Income Tax, on instructions, would submit that the petitioner's application for refund is under process; and, on completion of the said exercise, the amount, liable to be refunded, shall be refunded to the petitioner herein at the earliest, in any event not later than six weeks from today.

Ends of justice shall be met if the respondents are directed to refund the amount due to the petitioner at the earliest and, in any event, not later than six weeks from today. The Writ Petition stands disposed of accordingly. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
