HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.22189 of 2015 ORDER:

Heard.

The relief sought for in the writ petition is only with regard to consideration of petitioner's application for grant of NOC in terms of G.O.Ms.No.307, Revenue (Assignments. I) Department, dated 06-06-2013. The said application is stated to have been made on 1601-2014 to the 2nd respondent and alleging inaction, the present writ petition is filed.

The petitioner states that her husband, who was ex-serviceman, was allotted the land admeasuring Ac.5-00 gts., in Sy.No.49/5 situated at Nemaragomula Village, Bibinagar Mandal, Nalgonda District and he was also issued pattadar pass books and title deeds in respect of the said land. After the death of her husband, she claimed that she is in possession and cultivating the land but desires to sell the same as ten years period has already expired. She, therefore, made an application before the 2nd respondent in terms of G.O.Ms.No.307 referred to above on 16-01-2014.

Learned Government Pleader appearing for respondents states that if the application of the petitioner is pending as on date, the same shall be examined by the 2nd respondent and appropriate orders would be passed expeditiously.

In view of the above, the writ petition is disposed of directing the 2nd respondent to consider the petitioner's aforesaid application, dated 16-01-2014, if it is still pending and not disposed of, in terms of G.O.Ms.No.307, referred to above and pass appropriate orders expeditiously, preferably within six weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
