THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.3923 OF 2016 ORDER:
This Criminal Petition is filed by the petitioner-accused No.1 under Section 482 Cr.P.C., seeking to quash the proceedings against him in C.C.No.1373 of 2008 on the file of the Chief Metropolitan Magistrate, Hyderabad.
Heard and perused the material available on record. The petitioner and other accused are alleged to have committed the offence punishable under Sections 324, 504 and 506 IPC. It is alleged that when the de facto comlainant along with his friend went to their land situated in Sy.No.225 Kandikalgate village, Bandlaguda Mandal on the instructions of his brother to remove the bushes and clean the land, the petitioner, his brother, wife, mother and the followers of Huyyuru MLA, K. Parthasarthi, about 20 persons came in cars and stated that they purchased the said land from B. Chandra Mohan and threatened them to stop the work and attacked them with sticks and beat them with hands.
Considering the facts and circumstances of the case and the averments in the charge sheet, this Court is not inclined to interfere with the proceedings in the above C.C.
At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitioner before the trial Court is dispensed with except on the dates when his presence is specifically required by the trial Court. The petitioner is directed to be represented by a Counsel before the trial Court on all hearing dates.
Accordingly, the Criminal Petition is disposed of.
Consequently, miscellaneous petitions pending, if any, shall stand closed. The trial Court is directed to dispose of the above C.C. within
