HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 13667 of 2017 ORDER:
Heard the learned Counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for respondent Nos.2 and 3.
From the writ affidavit, it appears that there is a title dispute with respect to the land in Sy.No.78 admeasuring Ac.1.14 gts. situated at Hafizpet Village, Sherlingampalli Mandal, Ranga Reddy District. Except making an averment that the respondent - authorities are disturbing the possession and enjoyment of the petitioner's land, no material is placed before this Court, prima facie, to come to the conclusion that there was any such interference by the respondent - authorities. Apart from there being any material placed before this Court that the petitioner is in possession of the said land, it may also be noticed that the petitioner himself stated that the suit, in O.S.No.39 of 2017 on the file of Additional Junior Civil Judge, Kukatpally at Miyapur, is pending against respondent No.4.
The allegation in the writ petition is that, at the instance of respondent No.4, respondent - authorities are interfering with the possession of the petitioner.
All these facts eminently justify seeking a civil remedy rather than a writ.
The Writ Petition fails and is, accordingly, dismissed. Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
