HONOURABLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.4081 of 2019 ORDER:
The grievance of the petitioner association in this case is with regard to the alleged inaction on the part of the District Collector, Medchal-Malkajgiri District, in relation to the representation dated 14.11.2018.
Perusal of the said representation demonstrates that an earlier eviction order passed by the competent authority was set aside by the erstwhile High Court of Andhra Pradesh vide order dated 08.12.2008 passed in Writ Petition No.1887 of 2008 and the complaint of the signatories to the representation was that despite the same, the authorities were obstructing their development activities and their possession over the subject land. The matter was adjourned to enable the learned Assistant Government Pleader for Revenue, State of Telangana, to get instructions. He thereupon informed this Court that a resumption order was passed in relation to the subject land long ago and sought time to produce a copy thereof.
Today, the learned Assistant Government Pleader placed before this Court a copy of the proceedings dated 06.11.2012 passed by the District Collector & Tahsildar, Quthbullapur Mandal, Ranga Reddy District, under the provisions of the A.P. Assigned Lands (Prohibition of Transfers) Act, 1977.
SK, J WP.No.4081 of 2019 Dt:25.3.2019 Perusal of the said proceedings manifests that a copy thereof was marked to the General Secretary of the petitioner association. Sri Y.Randheer, learned counsel for the petitioner association, would however inform this Court that he has no information as to this development.
In any event, the complaint of the petitioner association as to inaction of the District Collector upon the representation dated 14.11.2018 stands settled in the light of the resumption order now produced. If the petitioner association is aggrieved by the aforestated proceedings dated 06.11.2012, it is for it to seek redressal thereof before the competent forum in accordance with the due procedure.
The Writ Petition is accordingly dismissed leaving it open to the petitioner association to do so.
Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
