HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.4519 OF 2017 ORDER:

This writ petition is filed declaring the inaction of the respondents in not evicting the trespassers from the petitioners' house plots situated in Survey No.220 of Maddurpadu, Kavali, SPSR Nellore District and in delivering possession to the petitioners as per the Decree and Judgment dated 06.06.2016, passed in OS.No.89/2002 on the file of the Court of Principal Junior Civil Judge, Kavali. The petitioner filed the present writ petition for execution of decree and judgment in OS.No.89/2002 which is filed for declaration of right, title or interest in the plaint schedule property. Though, the petitioner has alternative remedy for executing the decree and Judgment of the Court below, it is not known why the petitioner filed the writ petition for that relief. In view of the same, I do not see any reason to entertain the writ petition.

Accordingly, the writ petition is dismissed. No order as to costs.
