THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.10651 OF 2017 ORDER:

The action of respondent No.3 - Greater Hyderabad Municipal Corporation, in insisting 'No Objection certificate/ T.S.L.R.' from revenue authorities, for processing the application of the petitioner for issuance of construction permission in respect of the property in question, is questioned in this writ petition as being illegal and arbitrary. Both learned counsel for the petitioners and learned Standing Counsel for the respondent - Corporation would submit that this Court, in similar facts and circumstances in W.P.No.13008 of 2016 dated 19.4.2016, had directed the Corporation to receive and process the application of the petitioner for construction permission without insisting for production of TSLR Certificate and No Objection certificate from the revenue authorities.

This Court further directed that the Corporation shall ensure that the provisions of the Greater Hyderabad Municipal Corporation Act, 1955, the Rules and the Building Bye- Laws made thereunder are adhered to, while considering the petitioner's application therein for grant of building permission. In view of the facts and circumstances and the submissions of the learned counsel, this Writ Petition is disposed of at the stage of admission, in terms of the order of this Court in W.P.No.13008 of 2016 dated 19.4.2016.

Copy of the order of this Court, in W.P.No.13008 of 2016 dated 19.04.2016, be tagged to this order.

Miscellaneous petitions pending if any, shall stand closed. No order as to costs.
