HONOURABLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.14697 OF 2008 ORDER:

This writ petition is filed seeking to issue a writ of Certiorari calling for the records relating to and connected with I.D.No.49 of 2005 on the file of the Labour Court -II, Hyderabad, and to quash the award dated 4.2.2008 passed therein, by holding it as illegal and arbitrary; to direct the respondent to reinstate the petitioner into service with all consequential benefits such as continuity of service and back wages.

2. The petitioner challenged the award passed in the above I.D. where no relief was granted by the Labour Court in favour of the petitioner. It is noticed that the petitioner is at the verge of retirement. At this stage, there cannot be any direction to reinstate the petitioner into service. However, the respondent is directed to pay the service benefits to the petitioner for the services rendered by him prior to his removal, if not already paid, within a period of four weeks from the date of receipt of a copy of this order.

With the above direction, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
