HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26707 OF 2012 ORDER:

This writ petition is filed for a Mandamus declaring the action of the respondent in including the writ petitioner's shop/stall No.181, situated at Nallagandla Vegetable Market, Sherlingampally Mandal, Ranga Reddy District, in the list of vacant shops for conducting auction on 29.08.2012, vide notice dated 06.08.2012, even though the shop of the writ petitioner is not vacant, as illegal and arbitrary and for a consequential direction to the respondent to remove the said shop from the list of vacant shops. This Court on 28.08.2012, while ordering Notice before admission passed the following order in WP.MP.No.34022 of 2012: "The petitioner, prima facie, appears to be having no enforceable right against the respondent, and therefore, he is entitled to participate in the proposed auction and there shall be no interim restraint." Now, since there is no stay and petitioner was also permitted to participate in the auction and by afflux of time, nothing survives of adjudication in the writ petition.

In view of the above, the writ petition is dismissed as infructuous. No order as to costs.

As a sequel to the dismissal of the writ petition, Interim Orders, if any passed, shall stand dissolved.
