THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.4071 of 2019 ORDER:

Heard.

2. Petitioner claims to be the owner and possessor of the agricultural land in survey No.987 to an extent of Ac.0.19 1⁄2 gts. situated at Itipamula Village, Kattamguru Mandal, Nalgonda District. Petitioner alleges that without following due process, the respondents are interfering with his possession for the purpose of construction of 'Double Bed Room' houses and the same is illegal.

3. The 4th respondent-Tahsildar, Kattamguru Mandal filed counter affidavit.

In paragraph 7 of the said counter, it is stated that the Government land to an extent of Acs.2.00 guntas is vacant in survey No.987 and the same is allotted and handed over to the R & B Department on 10.02.2017 for construction of Double Bed Room houses and that the petitioner's land is not affected. Further, in paragraph 9 of the said counter it is stated that petitioner's land in survey No.987 to an extent of Ac.0.19 1⁄2 guntas is not required.

5. In view of the categorical assertion that the petitioner's land is not required and is not affected, the apprehension expressed by the petitioner of alleged illegal dispossession does not survive for consideration. There is no cause for the petitioner to apprehend such illegal dispossession.

6. The Writ Petition is accordingly disposed of. It is needless to observe that if the respondents require the land of the petitioner for public purpose, on due verification of the status of the land, they shall follow the due procedure to acquire the said land. Miscellaneous Petitions pending in this Writ Petition, if any, shall stand closed. No order as to costs.
