This Writ Petition has been filed complaining inaction on the part of the 3rd respondent Station House Officer, Punganuru Police Station in initiating investigation, pursuant to the complaints dated 25.05.2017 and 28.07.2017 of the petitioner, against the 4th respondent.
Heard learned counsel for the petitioner and learned Government Pleader for Home (Andhra Pradesh). This Court, in identical circumstances, while dealing with Writ Petition No. 25857 of 2017, on 04.08.2017, has passed the order, the operative portion of which reads as under: "
In the writ affidavit, there is no averment that the petitioner had approached respondent - authorities seeking status of investigation or the stage at which investigation had stalled or being proceeded with.
Even assuming that the petitioner had approached the respondent - authorities and they have not responded, she has right to approach the authorities under the Right to Information Act, 2005 (the Act) where the designated Public Information Officer is required to furnish necessary information within the time stipulated, state the reasons and the information that is required to be furnished on which queries are put. If no information is provided within the stipulated time, right of appeal is provided under the Act. In case, the information provided is not adequate, it would also give further opportunity to seek clarification".
In view of the above-said order, this Writ Petition is also disposed of in terms thereof. No costs.
