HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17499 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner is appointed as a Fair Price Shop Dealer of shop No. 15 of Marrivemula village, Pullalacheruvu Mandal, Prakasam District. On 19.05.2015 the Enforcement Deputy Tahsildar, Yerragondapalem inspected the shop of the petitioner and noticed some variation in stocks. The third respondent issued a show cause notice on 20.05.2015 based on the report of the Enforcement Deputy Tahsildar dated 19.5. 2015. The petitioner was asked to submit his explanation within seven days. But the petitioner did not submit his explanation within the said period. Thereafter the third respondent passed impugned order dated 01.06.2015 suspending the authorization of the petitioner pending further enquiry. Aggrieved by the same, the present Writ Petition is filed. It appears that the petitioner also preferred an appeal against the order dated 01.06.

However, having regard to the facts and circumstances of the case, the petitioner is given liberty to submit his explanation to the show cause notice dated 20.05.2015 within fifteen days from the date of receipt of a copy of this order and the third respondent shall complete the enquiry with regard to the charges levelled against the petitioner, by duly observing the principles of natural justice and pass final order within thirty days thereafter.

The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
