THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL PETITION No.1241 OF 2018 ORDER:

Heard learned counsel for the petitioners/A.1 to A.5, learned Additional Public Prosecutor for respondent State and perused the record.

This petition is filed under Section 482 Cr.P.C. to quash Crime No.2 of 2018 of Motakondur Police Station, Rachakonda, Nalgonda District.

It is contended that when these petitioners have complained with regard to cow slaughtering to the Village Revenue Officer, we lodged a report to the police on 15.01.2018. On the basis of that, a case in Crime No.1 of 2018 for the offences punishable under Sections 429 IPC and 10C of Telangana PCS and APA Amendment Act was registered against the de facto complainant herein. It is contended that after such registration of the complaint, this false case is foisted against the petitioners/A.1 to A.5. In view of the nature of the allegations and submissions made by both sides, it is appropriate to direct the Station House Officer/investigating officer as follows:

The Station House Officer/Investigating Officer shall not arrest the petitioners/A.1 to A.5 during investigation, complete the investigation of this crime and file final report. With the above direction, the Criminal Petition is disposed of. The Miscellaneous Petitions, if any, pending shall stand closed.
