THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.26249 of 2017 ORDER:

The petitioner states that he is running a fertilizer shop in the name and style of M/s.Srinivasa Traders. While so, on 15.06.2017 the third respondent and his team inspected the petitioner's shop, wherein they found 410 bags of paddy existing in the shop. The petitioner could not satisfy them with the explanation regarding existence of the said stock. Accordingly, it was seized after conducting panchanama. Now, proceedings under Section 6A of the Essential Commodities Act are pending before the second respondent. Apprehending sale of the stock, the present Writ Petition is filed.

Learned Counsel for the petitioner submits that the stock is only paddy and it is not subject to decay immediately. In the circumstances, the second respondent is directed to complete the proceedings under Section 6A of the Essential Commodities Act as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order, and in the meanwhile, the seized stock shall not be sold. The Writ Petition is, accordingly, disposed of.

The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs. ________________________________ (A.RAMALINGESWARA RAO, J) 07.08.2017 vs
