THE HON'BLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON No.4380 of 2019 ORDER:

The prayer of the petitioners in this case reads as under: 'For the reasons stated in the accompanying affidavit, it is therefore prayed that this Hon'ble Court may be pleased to issue a writ or order more particularly one in the nature of writ of mandamus declaring the action of the respondents 2 to 5 in not conducting survey, demarcation, fixing of boundaries with meets and bounds by conducting panchanama and also not issuing mutation proceedings and e-pahanies in spite of receipt of petitioners written application dated 9-4-2018 in respect of petitioners landed property covered by survey Nos.25, 26, 28, 30, 86, 87, 88, 89, 90, 92, 95, 96, 97, 98, 105 and 106 TS No.

7, 10/1, 10/2, 10/3, 10/4 situated at Hakeempet, Shaikpet mandal, Hyderabad as illegal, arbitrary, unjust and against the provisions of Survey and Boundaries Act 1923 and also against Article 300 A of Constitution of India and pass such other order or orders may deem fit and proper in the circumstances of the case.' Perusal of the record reflects that the petitioners merely made a written representation seeking relief without following the due procedure. The prescribed format for seeking mutation is by way of an application in Form VI(A) along with payment of the requisite fee under the Telangana Rights in Land and Pattadar Pass Books Act, 1971. For survey, demarcation and fixation of boundaries, an application has to be filed online by way of a F-line petition along with the requisite fee.

Without following the aforestated prescribed procedure, it is not open to the petitioners to make a written representation and complain of inaction on the part of the revenue authorities thereon.

the requisite fees for the reliefs that they seek from the revenue authorities. Such applications, as and when filed, shall be dealt with by the authorities concerned expeditiously.
