THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.84 of 2016 ORDER :

The following interim direction was passed in W.P.No.40837 of 2014 :

"Notice before Admission.

In the meantime, there shall be interim direction as prayed for." 2.

Alleging non-compliance of the said order, this contempt case is filed.

Learned Standing counsel representing the 2nd respondent submits that as per the Government orders on the subject matter, the Chief Executive Officer of Zilla Praja Parishad, is not competent to sanction or review the earlier decision and to grant Medical reimbursement. However, pursuant to the interim order of this Court, the Chief Executive Officer sent proposals to the Director Medical Education, Telangana State on 27.03.2015 and also sent reminders subsequently.

As seen from the order passed by this Court, the prayer sought was to direct the 2nd respondent herein (4th respondent in writ petition) to reconsider the representation dated 30.08.2014. Whereas reconsideration can be done only by the Director, Medical Education.

In view of the above, it cannot be said that the 2nd respondent violated the orders of this Court much less deliberately and willfully. No contempt case is made out for prosecuting the 2nd respondent under the Contempt of Courts Act.

Contempt case is accordingly closed. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
