Rallabandi Vani Kishore v. The Union Of India
THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.4138 of 2020 ORDER:
The present writ petition is filed to declare the action of the respondents in not recalling the Look-out-Circular (LOC) issued pursuant to issuance of FIR No.812 of 2019 on the file of Jeedimetla Police Station, Cyberabad, against the petitioner, as illegal and arbitrary. 2.
It is the case of the petitioner that, based on a complaint made by the wife of the petitioner, on 13.11.2019, a case in Crime No.812 of 2019 was registered, for the offences under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, on the file of Jeedimetla Police Station, Cybederabad, against the petitioner. To quash the proceedings in Crime No.812 of 2019, the petitioner filed Crl.P.No.1283 of 2019 before this Court and this Court allowed the said criminal petition, since the matter was settled outside the Court and the petitioner and his wife filed O.P(SR) No.2509 of 2020 before the learned XV Additional District Judgecum-II Additional Family Judge, Ranga Reddy District, Kukatpally, for dissolution of marriage by mutual consent and the same is pending. The grievance of the petitioner is that, despite quashing the proceedings in Crime No.812 of 2019, the respondent authorities are not recalling the LOC issued against the petitioner. Hence, the petitioner prays for a direction in this regard.
3.
Heard learned counsel for the petitioner, Sri P.Devender, learned standing counsel for Central Government appearing for respondents 1 to 3, and learned Assistant Government Pleader for Home appearing for respondents 4 to 6.
4.
Inasmuch as the respondent authorities issued the LOC pursuant to the registration of Crime No.812 of 2019 on the file of the 6th respondent police station, this Court is of the view that the petitioner would be required to approach the authority at whose behest the said LOC has been issued and this Court cannot interfere in such matters. 5.
Granting liberty to the petitioner to approach the authority concerned seeking revocation of the LOC by giving the sufficient reasons, the writ petition is closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
