This Criminal Petition, under Section 482 of the Code of Criminal Procedure, 1973, is filed by the petitioner/ accused to modify the order dated 28.11.2018 in Crl.M.P.No.1202 of 2018 in Crime No.178 of 2018 of V.M. Banjara Police Station on the file of the Principal Sessions Judge, Khammam. 2.

Heard the learned counsel for the petitioner/ accused, the learned Additional Public Prosecutor representing respondentState and perused the record. 3.

The Court below while dealing with the grant of bail under Section 438 Cr.P.C. was pleased to impose condition No.ii, which reads as under:

"The relief granted is upto the obtaining of opinion of the expert as to the genuiness of the signature on the cheque leaves and in the event the cheque being primarily opined to be the forged one, it is open to the Investigating Officer to effect arrest and if not bail continue."

The Court below has discussed the whole material on record and imposed the said condition. In such circumstance, the imposition of the said condition by the Court below cannot be faulted with. The petition is devoid of merit and is liable to be dismissed.
