HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 3702 OF 2006 ORDER :

This Writ Petition is filed seeking a Writ of Mandamus declaring the impugned proceedings dated 30.6.2005 issued by the 1st respondent herein, promoting the Unofficial Respondents herein to the post of Junior Assistant/Junior Assistant-cum-Typist, who are shown at Serial Nos. 17, 18, 21, 24, 26 and 27 respectively in the said proceedings, while denying promotion to the petitioners herein to the said post as illegal, arbitrary and sought a consequential direction to promote the petitioners as Junior Assistant/Junior Assistant-Cum-Typist with effect from the date of promotion of their immediate junior with all consequential benefits. 2.

It has been contended by the petitioners that they are fully eligible and qualified for promotion as Junior Assistants. But, the respondents, instead of considering their cases, considered the cases of their juniors and promoted them as Junior Assistants, vide proceedings dated 30.6.2005. Challenging the same, the present Writ Petition is filed. 3.

It has been further contended by the Counsel for the petitioners that during the pendency of Writ Petition, the petitioners were also promoted as Junior Assistants, however, with prospective effect and not on par with their juniors.

The Government Pleader, appearing for the respondents, has contended that the 1st respondent has promoted the Unofficial Respondents

by duly taking their merit into consideration and there are no merits in the Writ Petition and the Writ Petition is liable to be dismissed. 5.

Having considered the submissions made by the parties, this Court is of the considered view that this Writ Petition can be disposed of, directing the petitioners to make a representation seeking promotion on par with their juniors and consequential seniority over the Unofficial Respondents within two weeks from the date of receipt of a copy of this order and upon such representation being received, the 1st respondent shall consider and pass appropriate orders within a period of four weeks thereafter. 6.

With this observation, the Writ Petition is disposed of. 7.
