This Criminal Petition is filed under Section 438 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking anticipatory bail to the petitioner/Accused No.2 in Crime No.115 of 2024 on the file of Station House Officer, Karimnagar II Town Police Station, Karimnagar District, registered for the offences punishable under Sections 3, 4 and 5 of Immoral Traffic (Prevention) Act, 1956. 2.

The case of the prosecution in brief was that on 08.02.2024, on reliable information about running prostitution in the house of accused No.1, the police conducted search and apprehended accused Nos.1 and 2 along with victim women. Police registered the above crime and issued notices under Section 41-A of Cr.P.C., to accused Nos.1 and 2 and directed them to appear on the next day. But accused No.1 was arrested on 09.02.2024.

Heard learned counsel for the petitioner/Accused No.2 and learned Additional Public Prosecutor for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner was apprehending his arrest in view of arrest of accused No.1, who was also issued notice under Section 41-A of Cr.P.C. He further contended that the offence under Immoral Traffic (Prevention) Act would not attract against the petitioner, who was the customer. 5.

Learned Additional Public Prosecutor also conceded that the petitioner was a customer and that the above offences would not attract against the petitioner.

Considering the submissions of both the learned counsel, it is considered fit to enlarge the petitioner on anticipatory bail in the event of his arrest in Crime No.115 of 2024 on the file of Station House Officer, Karimnagar-II Town Police Station on certain conditions. 7.

Accordingly, the Criminal Petition is allowed and the petitioneraccused No.2 shall be released on anticipatory bail subject to the following conditions:

1) The petitioner/ accused No.2 is directed to surrender before the Station House Officer, Karimnagar-II Town Police Station, Karimnagar District, within a period of 15 days from the date of

On such surrender, the said Station House Officer shall release the petitioner/accused No.2 on bail, on his executing a personal bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties for a like sum each to the satisfaction of the said Station House Officer.

2) The petitioner/accused No.2 shall abide by the conditions stipulated under Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigation of the case.
