THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM A.S.M.P.No. 2719 OF 2017 And A.S.No. 56 of 2007 O R D E R:

A.S.M.P.No. 2719 of 2017 has been filed to pass a decree in the Appeal, in terms of the compromise.

It has been stated in the affidavit filed in support of this Application that against the decree and judgment dated 27.10.2006 passed by the learned Senior Civil Judge at Nizamabad in O.S. No. 75 of 2001 filed by the respondent herein for recovery of a sum of Rs.6,56,000/-, the petitioner - appellant filed the present Appeal, wherein stay of operation of the decree was also obtained on condition of depositing 50% of the decretal amount. Accordingly, a sum of Rs.3,50,000/- was deposited in the Court below and the said amount was also withdrawn by the respondent herein. It is further stated that both the parties have amicably settled the matter and entered into a compromise. For the above-said reasons, the Appeal is allowed and there shall be a decree in terms of the joint memo of compromise, under which the petitioner - appellant paid Rs.3,00,000/- through pay order bearing No. 962766, dated 13.09.2017 to the respondent towards full and final settlement.

Registry is directed to enclose the joint memo of compromise to the decree drawn in terms thereof. No costs. Consequently, the miscellaneous Applications, if any shall stand closed.
