THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.40186 OF 2015 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue.
The grievance of the petitioners is that the document presented by them in relation to Survey No.87-1F of Basinikonda Village, Kondamarri Panchayath, Madanapalle Mandal, Chittoor District, has not been entertained by the Sub-Registrar, Madanapalle, Chittoor District, the 4th respondent, in view of the letter addressed by the District Collector, Chittoor District to the respondents in Roc.No.A1/5824/2012, dated 17.10.2012, wherein the Sub Registrar was informed to stop all further transactions relating to Survey No.87 of Basinikonda Village pending enquiry before the institution of Lokayukta, Hyderabad. The petitioners submit that their lands are private patta lands and no Governmental interest is involved in them and have also filed a copy of the order of Lokayukta, Ex.P6, dated 20.07.2015, wherein complaint No.952/2002/B1 was closed.
Learned counsel for the petitioners states that in view of the closure of the said complaint before Lokayukta, the orders of the District Collector, dated 17.10.2012, referred to above, do not any more operate and there is no impediment for entertainment of registration of private patta lands.
It is not evident from the record that whether closure of the said complaint before Lokayukta is brought to the notice of the District Collector and the 4th respondent. Hence, it is open for the petitioners to present the document in question along with the copy of the order of Lokayukta, dated 20.07.2015, and request the 4th respondent to
receive and process the same. If the document is presented by the petitioners, the 4th respondent shall receive and process the same. The petitioners are also at liberty to seek direction from the District Collector and the District Registrar regarding entertainment of the document relating to Survey No.87 for the purpose of registration in view of the subsequent order of Lokayukta, dated 20.07.2015. Thereafter, the 4th respondent shall act in accordance with such direction.
The Writ Petition is accordingly disposed of. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
