ORDER:

Heard.

2. Evidently, petitioner was granted permission for de-casting of sand in his patta land vide proceedings of the Assistant Director of Mines and Geology, dated 05.02.2015. Last paragraph whereof reads as follows: "On the request made by the Pattadar/Dealer, this office vide Transit Passes Endorsement No.17/MDR/NLG/2014-15 dated 05.02.2015 has permitted the pattadar to transport/ dispatch the sand from the stock yard with effect from 05.02.2015 to 20.02.2015. The total validity period for the entire sand dispatches will be stopped with effect from 20.02.2015 mid night onwards."

3. The grievance of the petitioner in this writ petition is that in spite of the

said order, respondent No.3 has not issued transit passes.

4. Since the permission granted to the petitioner is time bound and will be exhausted by 20.02.2015, any delay on the part of respondent No.3 in issuing transit permits would frustrate the proceedings dated 05.02.2015 issued in favour of the petitioner. I see no reason why respondent No.3 should not issue transit passes in terms of the said order, dated 05.02.2015.

5. Hence, the writ petition is disposed of directing respondent No.3 to comply with the order, dated 05.02.2015, particularly the portion extracted above, by issuing necessary transit passes to the petitioner as per his request, without any further loss of time.

As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
