THE HON'BLE DR.JUSTICE SHAMEEM AKTHER WRIT PETITION NO.29474 OF 2017 ORDER:

This Writ Petition is filed seeking to declare action of respondent No.3 in proceeding with FIR No.505 of 2016 of Sadashivpet police station, Sanga Reddy District registered for the offence punishable under Section 304A IPC, against the petitioner.

Heard the learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

It is urged before this Court that the petitioner is owner of crime vehicle bearing registration No.MH46AF 9583 in the aforesaid crime, but he entrusted the said vehicle to Harsha Roadways, represented by its proprietor Mr.Sonu Mittal, for appointment of driver, maintenance, etc. and that the petitioner is not connected with the alleged offence punishable under Section 304A IPC said to have been committed by driver of the said vehicle. The offence alleged is bailable. Without determining anything on merits of the case, it is appropriate to direct the Station House Officer concerned to conduct investigation in the above crime without arresting the petitioner. The petitioner shall cooperate with the investigating officer. If required, he shall file copies of documents, which are available with him, relating to the crime vehicle, in the course of investigation. 4.

With the above direction, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in the Writ Petition shall stand closed.
