Heard the learned counsel for petitioner and learned standing counsel for respondent corporation and with their consent the writ petition is taken up for disposal at the admission stage itself.
Grievance of the petitioner is that his neighbors/respondents 3 and 4 made illegal constructions by encroaching the government land and even electrical pole. Alleging that no action is taken in spite of brining it to the notice of the respondent corporation, who kept quiet even though notice under Section 452 (2) of HMC Act, 1955 (for short the Act) was issued on 5.1.2015, this writ petition is filed. When the matter is taken up, Sri P.Kesav Rao, learned standing counsel for respondent corporation submits that notice under Section 452 (2) of the Act was issued on 5.1.2015 and notice under Section 636 of the Act was issued on 12.1.2015 and since there was some law and order problem apprehended by the respondent corporation, the corporation has requested the police authorities to provide police protection and they have addressed series of letters in this regard i.e., on 16.1.2015, 29.1.2015, 10.2.2015 and latest being 8.6.2015 and that the corporation is actively pursuing the matter.
Having regard to the same, the writ petition is disposed of directing the respondent corporation to take appropriate course of action as warranted by law consequent to notices already issued and letters addressed by the corporation to the local police. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
