HON'BLE SMT. JUSTICE T.RAJANI CRIMINAL PETITION No.1246 OF 2018 ORDER:

This Criminal Petition is filed by the petitioner/accused in Crime No.23 of 2018 on the file of the Kothavalasa Police Station, Vizianagaram District, for grant of anticipatory bail. The offence alleged is under Section-353 IPC. Heard the learned Counsel for the petitioner and the learned Public Prosecutor appearing for the respondent. Perused the record.

As per the case of the prosecution, this petitioner obstructed the duties of the de facto complainant, who is the Tahsildar of Kothavalasa, while he was recording the statement of the driver of the vehicle, through which water was being transported. The allegation is that the water was being sold at higher rates from Sri Maridimamba Charitable Trust, without any permission. It is also alleged that this petitioner previously also misbehaved with the office staff and he is behaving as a rowdy periodically.

Considering the nature of the allegations against this petitioner, this Court opines that this is not a fit case for grant of anticipatory bail to the petitioner. However, the petitioner can surrender before the Court concerned and seek regular

bail. On such surrender, the concerned Court is directed to consider the bail application of the petitioner on merits and in accordance with law on the same day subject to the regular pressure of work.

With the above observation, the Criminal Petition is disposed of.

As a sequel, the Miscellaneous Petitions, pending if any, stand closed.
