This petition is filed, under Section 438 of the Criminal Procedure Code, seeking grant of anticipatory bail to the petitioner in Cr.No.1 of 2018 on the file of the Station House Officer, Machavaram Police Station, Guntur District.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The counsel for the petitioner submits that the petitioner is not shown as accused yet, but from the remand report, he apprehends that he will be shown as accused and he will be arrested. 4.
The remand report shows that some more witnesses have to be secured and examined, after which the complicity of the petitioner and other person is to be verified.

Simply because the name of the petitioner is shown in the remand report, he would not be entitled for anticipatory bail, when the allegations would not entitle for such relief. Hence, unless the role of the petitioner comes out and unless there is any proposal from the police to arrest the petitioner, this Court opines that there need not be any apprehension for the petitioner with regard to his arrest.
