Sunil Agarwal v. B.Lakshminarayan
THE HON'BLE SRI JUSTI CE M.SEETHARAMA MURTI CI VI L REVI SI ON PETI TI ON Nos.2603 & 6494 of 2016 COMMON ORDER:
Since the facts of the cases and the issues involved in both these revisions are identical and as the parties are also common, both these revisions are being disposed of by this common order. 2.
At the earlier hearings, the learned counsel for the petitioner in both the revisions submitted that the main dispute is about the identity of the party prosecuting the proceedings before the trial Court and, therefore, if the respondent-plaintiff appears before this Court and affirms that he is the person prosecuting the proceedings before the trial Court, the revision petitioner will have no grievance and he will withdraw the revision petitions. Accordingly, directions are given for appearance of the respondent-plaintiff before this Court.
3.
Eventually, as per the directions of this Court, the respondent/plaintiff appeared before this Court today. His identity is not disputed. Nevertheless, he produced a photostat copy of his AADHAR Card and the same is placed on record. He affirmed that he is personally prosecuting the proceedings, which are pending before the trial Court. 4.
As already noted, according to the learned counsel for the petitioner, the main dispute in both the revisions is only with regard to the identity of the person prosecuting the proceedings before the trial Court. In view of the fact that the respondent/plaintiff appeared in person before this Court today and established his identity and affirmed
MSRM, J CRP Nos.2603 & 6494 of 2016 that he is personally prosecuting the proceedings before the trial Court, and as the grievance of the revision petitioner/defendant is accordingly redressed, the learned counsel for the petitioner fairly submitted that both these Civil Revision Petitions may be dismissed as withdrawn. 5.
Accordingly, both the Civil Revision Petitions are dismissed as withdrawn. There shall be no order as to costs. Miscellaneous petitions pending, if any, in these revisions shall stand closed.
