THE HON'BLE SRI JUSTI CE ABHI NAND KUMAR SHAVI LI WRI T PETI TI ON NO. 19215 OF 2004 ORDER:

When the matter is taken up for hearing, none appeared for the petitioner in spite of the fact that the matter is listed under the caption, "For dismissal".

At the time of admission, this Court granted interim stay of recovery of the amount on the condition that the petitioner pays Rs.2,000/- p.m. till further orders.

A perusal of the record discloses that the petitioner has challenged the action of the 3rd respondent in directing 1st respondent to deduct the petitioner's total salary amount, without permitting 2/3rd gross after deductions to his family life, as illegal and arbitrary. It is further noticed that the petitioner has attained the age of superannuation during the pendency of the Writ Petition.

Hence, the cause in the Writ Petition does not survive and the Writ Petition is accordingly dismissed as infructuous. Pending miscellaneous petitions, if any, shall stand dismissed. No order as to costs.
