THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.24769 of 2017 ORDER:
Heard the learned counsel for the petitioner and Sri D.Ramesh, learned Standing counsel for the A.P. Capital Region Development Authority (for short, 'APCRDA'). When the petitioner made an application seeking exemption under the A.P. Capital City Land Pooling Scheme (Formulation and Implementation Rules, 2015, the 3rd respondent rejected the same by way of proceedings, dated 18.08.2016. Aggrieved by the said order, the petitioner filed an appeal on 10.02.2017 before the appellate authority, 2nd respondent herein, who, vide proceedings Rc.No.57/Unit14/2015, dated 17.02.2017, referred the said appeal to the Joint Committee and Commissioner under (LPS Scheme) APCRDA, 6th respondent herein.
This Court, on 26.07.2017, while ordering notice and granting time to the learned Standing counsel to get instructions, granted status quo order.
When the matter is taken up, it is submitted by the learned Standing counsel for APCRDA that the issue in the present writ petition is pending before the Joint Committee, 6th respondent, and no final decision has been taken so far. He therefore requests that necessary direction may be issued to the 6th respondent to take appropriate action in the matter in accordance with law.
Having heard the learned counsel for the petitioner and the learned Standing counsel, this Court deems it appropriate to dispose of the writ petition with a direction to the 6th respondent to pass appropriate orders on the appeal said to have been filed by the petitioner in accordance with law, after giving notice and opportunity of hearing to the petitioner. Till such exercise attains finality, the order of status quo granted by this Court on 26.07.2017 shall continue to operate. The writ petition is accordingly disposed of. No order as to costs.
Miscellaneous petitions, if any, shall also stand disposed of.
