HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 28303 of 2015 ORDER:

Heard learned Counsel for the petitioner and learned Standing Counsel for respondents 1 to 4.

This Writ Petition has been filed challenging the inaction on the part of respondents 1 to 4 in not constituting a Managing Committee to the wakf institution, namely, Madeena -e-Masjid (Market), situated in B.K. Bazar, Khammam Urban, Khammam District.

The petitioner states that he has submitted a representation on 03.08.2015 to the first respondent along with other members for constitution of Managing Committee and that after receipt of the said representation, the fourth respondent

conducted an inspection and submitted a report to the first respondent on 5.8.2015. However, when no action has been taken, the present Writ petition is filed.

The learned Standing Counsel appearing for the respondents submits that pursuant to the representation submitted by the petitioner, the fourth respondent submitted a report. It is further submitted that now the fourth respondent is suspended pending enquiry and in those circumstances the first respondent couldnot take expeditious action. It is also submitted that the first respondent, however, is taking steps for constituting a Managing Committee and in that view of the matter, no further orders need be passed in the Writ Petition. Having regard to the aforesaid submissions, this Writ Petition is disposed of directing the first respondent to take necessary action for constitution of Managing Committee to the aforesaid wakf institution as expeditiously as possible, but not later than three months from the date of receipt of a copy of this order.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
